Public Report of the Ethics Board

Issued pursuant to Part 7 of the Prosecution Act 2025

Honourable Members and Members of the Public,

This report is published in accordance with Part 7, Section 4 of the Prosecution Act 2025, following the conclusion of the Ethics Board convened to review the evidence submitted in the matter set out below. It records the evidence in question, the outcome of the Board’s vote, a summary of both sides of the argument, and closing remarks.

The Board was constituted under Part 7 of the Prosecution Act 2025, chaired by the Attorney General and deputy-chaired by the President-Elect. All members confirmed in writing their willingness to serve impartially and in compliance with White House law prior to disclosure of the matter.

3.  The Evidence in Question

The submitting party referred a written statement together with three (3) screenshots captured from the Habbo Hotel mobile application’s “Chat history” view. As the material did not, on its face, satisfy the evidentiary requirements of Part 6, it was referred to this Board for certification on moral and ethical grounds.

Scope of review:  Consistent with Part 7, the Board did not determine the merits of the underlying matter. Its sole task was to decide, by majority vote, whether the evidence is legitimate — genuine, unmodified and uncontaminated — and fit to be certified on moral and ethical grounds.

4.  Result of the Vote

Determination:  The Board was deadlocked at 3 votes to 3. In accordance with the presiding process, the Deputy Chairman and President-Elect exercised a casting vote against certification. The Board accordingly resolved NOT to certify the evidence. In accordance with Part 7, this review is final and may not be overturned or ignored by any authority.

5.  Summary of Both Sides of the Argument

In favour of certification

• No indications of manipulation, editing or alteration were identified; the format, chat layout, usernames, timestamps and message flow were consistent with the Habbo mobile “Chat history” view.
• The absence of a room information box and calendar date reflects a fixed limitation of the mobile “Chat history” view — which does not render a room name, owner or date at all — rather than any omission, cropping or choice by the submitting party.
• Part 6 exempts app-client screenshots from the URL requirement, so that requirement was not in issue.
• The three screenshots follow a reasonable chronological order (approximately 09:46–09:47, 09:50, and 10:02–10:03) and, read together with the statement, present a coherent and consistent account.
• The Ethics Board exists precisely to consider evidence that does not meet Part 6 on its own terms; had the material been fully compliant, it would not have required certification. Certification would be for prosecution purposes only, with the merits reserved to the Court.

Opposed to certification

• Part 6, Section 2 requires any Habbo Hotel screenshot to include the room information box (room name and room owner), which is absent from all three screenshots; the law is clear as to what must be included, and the requisite element is not present.
• A platform limitation does not, in itself, excuse the absence of a required element from the material submitted.
• Completeness: the chat history is not continuous — there are gaps between the captured timestamps (approximately 09:47 to 09:50, and 09:50 to 10:02, some fifteen minutes in aggregate) — raising the possibility that relevant context is missing.
• On moral and ethical grounds, a final judgement could not be reached with confidence on an incomplete picture of the facts, absent the missing portions or further corroboration.

An optional section is provided under Part 7, Section 4 for any member wishing to record final remarks. No further individual notes were submitted beyond the reasoning summarised above; the section is retained for completeness.

7.  Closing Statement of the Attorney General

The Board discharged its duty with diligence, professionalism and impartiality throughout, engaging carefully with both the legitimacy of the material and the ethical considerations before it, and completed its review within the timeframe prescribed by Part 7. Following a deadlocked vote, the deciding vote of the Deputy Chairman resulted in the evidence not being certified. The Chair thanks each member for their thoughtful and principled service. This decision is final.
