1.  Establishment & Composition

The Ethics Board (WH-EB-05) was established under Part 7 of the Prosecution Act 2025 to review evidence submitted for certification and to determine, by majority vote, whether it should be certified as legal evidence of wrongdoing on moral and ethical grounds.

Change in membership:  Board member "kas?" was removed from office (dismissed) on 13 July 2026 and, to keep the Board properly constituted at five members, was replaced by a newly and randomly assigned member, "Gatorgal", who confirmed willingness and impartiality before the Board proceeded. In accordance with Part 7, the departed member remains strictly bound by confidentiality.
 

2.  The Evidence in Question

The Department of Defense submitted a body of evidence (screenshots) in support of a Ban on Sight and National Punishment placement against the Habbo user "Xilophenium". The material did not comply with the standard evidentiary requirements of Part 6 of the Prosecution Act 2025 and was therefore referred to the Ethics Board for review and possible certification under Part 7.

  • Submitting authority: Department of Defense (on behalf of the DoD and the Department of State).
  • Subject of the matter: Habbo user "Xilophenium".
  • Relief sought in the underlying matter: Ban on Sight (BoS) and National Punishment (NP) placement.
  • Documentation reviewed: "Department of Defense – BOS/NP Placement – Xilophenium" report.

Scope of the Board’s task:  The Board did not decide the merits of the underlying case. Its sole function was to review the submitted evidence and vote, on moral and ethical grounds, on whether the material is legitimate and should be certified as legal evidence of wrongdoing.
 

3.  Voting Record

Question put to the Board: “Are you willing to certify this evidence?”  The matter was decided by majority vote via a poll, which closed on 13 July 2026.

4.  Determination

Decision:  The evidence IS CERTIFIED. By a majority of 6 votes in favour to 0 against (with 1 abstention), the Board certified the submitted evidence as legal evidence of wrongdoing on moral and ethical grounds.
 

Pursuant to Part 7, Section 3(2)(3) of the Prosecution Act 2025, this review is final and may not be overturned or ignored by any authority. The Board is disbanded upon publication of this report.

Effect of certification (Part 7, Section 3, Subsection 2): once certified, the evidence may be used against the offending party in the courts, or by a leadership member, subject to all punishment laws and the prohibition on setting unreasonable punishments.

5.  Summary of Both Sides of the Argument

In favour of certification

  • The evidence, although technically non-compliant with Part 6, was reviewed and found to be legitimate and authentic.
  • The material was neither spam/trolling nor minor in consequence, and it reasonably supports the DoD/DoS request regarding the user "Xilophenium".
  • The majority were satisfied that the evidence met the moral and ethical threshold for certification under Part 7.

Concerns raised / against

  • One member initially proposed certifying only parts of the evidence and voting on each piece or set separately.
  • Upon further evaluation that member changed position and voted in favour, subject to the observation that Exhibits "T" and "U" appear to be duplicates of evidence already admitted and are therefore unnecessary.
  • No member voted against certification.

6.  Board Members’ Final Notes (Optional)

Exhibits "T" and "U" appear to be duplicates of already-admitted evidence and are unnecessary; this observation did not, however, prevent certification of the evidence as a whole.

7.  Final Statement from the Attorney General

The Board was properly constituted, each member confirmed their impartiality and willingness to serve, and the evidence was reviewed within the legal timeframe set out in Part 7. All members served in compliance with White House law. I thank the Board for its professionalism and diligence throughout these proceedings. The determination of the Board is final.
