REGARDING THE CERTIFICATION OF EVIDENCE — CASE EB-07

Matter:  Ethics Board Review of Evidence Submitted for Certification in Relation to the Firing of User “Kas?”

Note: Member pawtistic initially served on this Board but resigned prior to the review of the evidence, having declared a conflict of interest that may have affected impartiality. In accordance with proper procedure, member gatorgal was subsequently appointed to the Board and confirmed both willingness and readiness to proceed.

II.  Purpose of the Report

Pursuant to the reporting requirements governing the Ethics Board, this public report is issued following the Board’s decision regarding the certification of evidence submitted for review.

Pursuant to Part 7 of the Prosecution Act 2025, this Ethics Board (EB-07) was established to review the evidence submitted for certification and to determine, by majority vote, whether the evidence should be certified as legal evidence of wrongdoing on moral and ethical grounds.

The Speaker of the House submitted the evidence to this Board for review, as the material did not comply with the proper evidentiary standards set out in the Prosecution Act 2025, in relation to the firing of the user known as “Kas?”. The Board’s function was limited to determining the legitimacy of the evidence and not the merits of the underlying case.

III.  Evidence in Question

The evidence placed before the Ethics Board concerned the firing of the user known as “Kas?” and consisted of material submitted by the Speaker of the House.

The primary evidence originated from an automated logging bot bearing a verifiable Message ID, allowing the record to be independently confirmed. The reporting party was clearly identifiable, and the subject herself admitted to posting and subsequently deleting the message in question.

The evidence was submitted for the purpose of determining whether it should be certified as legitimate legal evidence for use in relation to the relevant proceedings, on moral and ethical grounds under Part 7 of the Prosecution Act 2025.

IV.  Ethics Board Vote

Following review and consideration of the submitted material, the Ethics Board voted as follows:

V.  Certification Decision

Based on the unanimous vote of the Ethics Board, the evidence was:

Accordingly, the evidence may be relied upon for the relevant legal or procedural purpose connected to the firing of the user known as “Kas?”, subject to any applicable evidentiary rules, court procedure, or further review required under White House law.

VI.  Summary of Arguments

A.  Argument in Favor of Certification

Those in favor of certifying the evidence found that the submitted material met the required standard for legitimacy.

The primary proof originated from an automated logging bot bearing a verifiable Message ID, which allowed the record to be independently confirmed. The reporting party was clearly identifiable, and the subject herself admitted to posting and subsequently deleting the message in question.

No indications were identified that the material had been edited, altered, manipulated, or otherwise compromised. The members were reminded that their vote spoke only to the legitimacy of the evidence, and not to the merits of the underlying case. On that basis, the members were satisfied that the evidence was legitimate.

B.  Argument Opposed to Certification

No members of the Ethics Board voted against certification.

As such, there was no formal opposing vote recorded. However, the Board acknowledges that all evidence submitted for certification must still be reviewed carefully, with attention to reliability, relevance, context, and compliance with applicable evidentiary standards.

VII.  Final Notes from Members of the Board

No separate final notes were submitted by members of the Ethics Board for inclusion in this public report.

VIII.  Final Statement from the Attorney General

Having overseen the review conducted by the Ethics Board, I confirm that the voting has concluded, with seven (7) votes in favor of certification and none opposed.

The Board was reminded that its function was not to decide the merits of the underlying case, but to review and determine whether the evidence presented was legitimate. On the basis of the unanimous decision reached, I am satisfied that the evidence meets the required standard and should be certified.

On my personal behalf, I wish to state that I fully respect the views and positions expressed by the members of the Ethics Board in this matter. I recognise that each member reviewed the evidence from their own perspective and formed their view in good faith. I further acknowledge and thank the member who, upon identifying a conflict of interest, acted with integrity in stepping aside to preserve the impartiality of this Board.
