MAJORITY OPINION.- The Constitution under Article 4 gives the Supreme Court the power to determine incompatability with existing law or the Constitution.

The core problem with this Amendment is the conflict with current Statute Law. The Amendment under Part 1, Section 1, Subsection 11, Clause 1, Subclause 2 indicates the criminal act of Contempt of Court would be a Class C offense; whereas Part 8, Section 4, Subsection 4 of the Prosecution Act 2025 designates Contempt of Court to be a Class B offense.

This is a direct inconsistency in which the Constitution intended to avoid.

WHEREFORE.- The Crimes (Amendment 2) Act 2026 is hereby declared UNCONSTITUTIONAL in its entirety and shall not take effect.
