MAJORITY OPINION.—The Group Badges (Amendment 2) Act 2026 creates conflicts in legislation.

(1) Part 1, Section 15(1)(1) of the Crimes Act 2025 states that the crime of Fake White House Badges shall be defined as "Owning or Joining a [WH] badge that is not owned by Praeceptor", discounting those badges owned by members of the “[WH] Authorized Owners ID” as well as Financier, WHRC and WhiteHouse-RC, following P1, S15(1)(1)(1–2) of the same act. While it is already quite unclear what this means – because what is a "[WH] badge"? It must be understood as an official White House badge.

(2) Part 1, Section 1(5) of the Group Badges Act 2025 states that "All Group Badges created must be owned by any member of the “[WH] Authorized Owners ID” Group Badge". And this is a principle continued through the Group Badges (Rewrite) (Amendment 1) Act 2026, in case that is ruled constitutional.

The Group Badges (Amendment 2) Act 2026 does not legislate the process by which these presidential campaign badges become "official group badges" during an election – it does, for example, not require the presidential candidates be let into the “[WH] Authorized Owners ID”. As such, these campaign badges would become official group badges, but would not be owned by a member of the “[WH] Authorized Owners ID”, thereby making whomever owns the badge or joins the badge liable for prosecution under Part 1, Section 15 of the the Crimes Act 2025.

WHEREFORE.—The Group Badges (Amendment 2) Act 2026 is hereby declared UNCONSTITUTIONAL, and thus shall not take effect.

SO ORDERED.—Associate Justice .Martin delivered the opinion, in which Senior Associate Justice Inconclusive- joined.
Dreckly and Kelpti voted and agreed with the court opinion.
