Prosecution (Legal Representation) (Amendment 7) Act 2026

Amends the Prosecution Act 2025 to strengthen an individual’s ability to choose their legal representation. The Act prevents the Department of Justice from declining specifically requested attorneys and creates a new section outlining how legal representation works. Any person, including nonโ€‘employees, may request a certified White House attorney for White House related matters, and attorneys may process legal documents on a client’s behalf. Attorneys may refuse representation, but the Department of Justice may assign one if no others are available. The Act also expands attorneyโ€‘client privilege to cover legal advice and private documentation, and confirms that representation is free of charge. These changes ensure fair access to appeals and legal proceedings, and reinforce protections established under the Prosecution (Case Confidentiality) Act 2026.
